THE COURT OF JUSTICE

These general conditions shall apply to the purchase of products carried out remotely by means of a telematic network through the site https://www.dimensionepesca.com/en/ owned by Dimensione Pesca SRL with registered office in Via Ammiraglio Cagni 34/46 BRINDISI 72100 (Br) Match Iva 02518760745.

The purchase operations will be governed by the provisions of Legislative Decree 206/05, while the protection of confidentiality (privacy) will be subject to the discipline of Legislative Decree 196/03. These general conditions are valid from 01/01/2012. They may be updated or modified by Fishing Size at any time, without notice, and will be valid from the date of publication on the website https://www.dimensionepesca.com/en/. The consumer undertakes and obliges, whenever a change of these general conditions takes place, to take a look at them and if it considers it appropriate to provide for their printing and conservation.

By contract of sale online means the distance contract between a supplier, dimension fishing SRL with registered office in Via Ammiraglio Cagni 34/36 BRINDISI 72100 (Br) Match Iva 02518760745, and a consumer customer, within a distance sales system organized by the supplier, i.e. the legal shop having object mobile goods and/or services, which for this distance exclusively uses the internet communication technology.
The consumer is the natural person who acquires goods and services for purposes not directly related to the professional activity which may be carried out.

Art. 1: ACCETTING OF SALE CONDITIONS

• 1.1 The conditions laid down in the premise are an integral and essential part of this contract.
• 1.2 All contracts will be concluded directly through access by the Customer (business and private) to the website corresponding to the address https://www.dimensionepesca.com/en/ . To this point the Customer can conclude the contract for the purchase of the desired product by following carefully the indications and procedures provided.
• 1.3 These general terms of sale must be examined online by the customer, before completion of the purchase procedure. The forwarding of the order confirmation therefore implies total knowledge of the same and their full acceptance.
• 1.4 The customer, with the sending of the confirmation of his order of purchase, accepts unconditionally and is obliged to observe, in his dealings with Size Fishing, the general conditions and payment below illustrated, declaring he has seen and accepting all the indications provided by him pursuant to the above rules, taking also note that Size Fishing is not considered bound under different conditions unless previously agreed in writing.

Art. 2: PRICES OF SALE AND MODE OF ACQUISTO

• 2.1 All the sales prices of the products displayed and indicated within the website https://www.dimensionepesca.com/en/ for which they are offered to the public pursuant to art. 1336 c I.V.A. and any other tax.
• 2.2 The total cost of the shipment to the customer's domicile is to the customer himself, unless otherwise specified. This cost will be, in any case made known to the customer before confirming the purchase.
• 2.3 The purchase contract is completed by the exact compilation and consent to the purchase manifested through the online date membership after registering.
• 2.4 The customer can pay the ordered goods using the payment methods indicated online at the time of purchase.
• 2.5 The prices of the different types of transport are related to weight, bulk and delivery destination.

Article 3

• 3.1 Size Fishing will deliver to customers, at the address indicated by the customer, the products selected and ordered, in the manner provided by the previous article, by means of couriers.
• 3.2 The goods purchased will be delivered within the deadlines provided for in art. 6 D. Lgs 206/05. No liability may be attributed to the supplier for delay or failure to deliver due to force majeure or fortuitous case. In detail: check the stock availability, Size Fishing will provide the immediate order escape, at the address indicated on the form. The normal delivery times for the Italian territory, on delivery, provide for the delivery of the goods within 24 hours (not considered on weekends and public holidays). In particular cases, islands or in a peripheral area, delivery times may last up to 72/96 hours. For overseas delivery times vary depending on the destination area, from a minimum of 3/5 working days from the time of shipment.
• 3.3 The customer is required to verify, at the time of receipt, the integrity of the package; only after such verification, the customer will have to subscribe the delivery documents. If the parcel present of the tampers or breaks will have to be affixed to the delivery document of the courier the word "Accepts with control reserve". Only by carrying out this procedure you can request reimbursement of any damage.
• 3.4 Subsequently the customer will have to verify the integrity of the products and the quantitative and qualitative correspondence with the indicated in the accompanying document. In case of difformity, the same must be reported within seven days by email or recommended to. r., Fishing Size. Even in the presence of integro packaging, the goods must be verified within seven days of receipt. Any hidden anomalies, must be reported in writing by email or recommended to. r. . Any reporting beyond these terms will not be taken into account. For each statement, the customer assumes full responsibility for what is stated.
• 3.5 Delivery at home, unless otherwise agreed between the parties, will take place on the ground floor and in the office hours: from 8.00 to 13.00 and from 14.00 to 18.00, everyday, not public holidays, from Monday to Friday.
• 3.6 The customer is obliged to make himself available in the times described in point 3.5, in order to avoid any additional charges due to lack of deliveries by the express courier, charges that in case otherwise will concern the customer himself.

Art. 4: PRODUCT DISPONIBILITY

• 4.1 The customer can only buy the products currently present in the electronic catalog of Size Fishing visible online at the address (URL) https://www.dimensionepesca.com/en/. If the request made by an online order exceeds the amount available for a given item, Size Fishing will accept the purchase limited to what is actually available to its virtual warehouse. It will be care of the Fishing Size Customer Service to make known to the customer (by phone or e-mail) if the ordered products will be or not available in the future

Article 5: RESPONSIBILITY

• 5.1 The fishing dimension assumes responsibility for disservices due to force majeure such as accidents, explosions, fires, strikes and/or locks, earthquakes, floods and other similar events that prevented, in whole or in part, execution in the agreed time of the contract.
• 5.2 The fishing dimension shall be responsible for any party or third parties concerning damages, losses and costs incurred as a result of the non-performance of the contract for the abovementioned causes, having the consumer only entitled to return the price paid.
• 5.3 Fishing Size is not responsible for any fraudulent and unlawful use that may be made by third parties, credit cards, cheques and other means of payment, upon payment of the purchased products. Size Fishing at no time of the purchase procedure is able to know the number of credit card of the buyer who, through a protected connection, is transmitted directly to the manager of the banking service.

Art. 6: GARANCES AND MODELS OF ASSISTANCE

• 6.1 The quality of our products is placed at the top of the respective categories and the modes of storage and shipment have been designed to ensure its preservation over time, the product may differ slightly from that in photos present on the site https://www.dimensionepesca.com/en/, this demonstrates the craftsmanship and high artistic profile that guarantee the uniqueness of each piece. Dimension Fishing produces or buys directly from the manufacturers who certify the quality and declares that all the products present in the catalogue and marketed are in accordance with the technical standards provided by law and good construction technique and is considered exempt from any damage caused by the bad use of the products without having adopted the normal diligence by the Customer.
• 6.2 Size Fishing, Single Supplier for Site https://www.dimensionepesca.com/en/, markets and produces high quality products. Both Fishing Size and other manufacturers of such goods offer a guarantee whose duration is 2 years. The guarantee decorates from the day of purchase of the good. This service is directly provided by the manufacturers of goods

Art. 7: BUILDING

• 7.1 The consumer undertakes and undertakes, once the online purchasing procedure has been completed, to provide for the printing and preservation of these general conditions, which, moreover, will have already seen and accepted as a necessary step in the purchase, as well as the specifics of the product object of the purchase, and this in order to fully satisfy the condition referred to in art. 3 and 4 of Legislative Decree 206/05.
• 7.2 These general conditions can be updated or modified at any time by Size Fishing which will provide communication through its website. The consumer undertakes and obliges, whenever there is any change in these general conditions, to provide for their printing and conservation.
• 7.3 It is strictly forbidden to the purchaser to enter false, and/or invented, and/or fancy data, in the registration procedure necessary to activate the process for the execution of this contract and its further communications; personal data and e-mail must be exclusively personal and not third-party data, or fancy.
• 7.4 It is expressly forbidden to make double recordings corresponding to one person or enter third-party data. Fishing Size reserves the right to legally pursue any violation and abuse, in the interest and protection of consumers all.
• 7.5 The Customer raises Fishing Size from all liability arising from the issue of incorrect tax documents due to errors related to the data provided by the Customer, being the sole Customer responsible for the correct insertion.

Art. 9:

• 9.1 By filling out the appropriate space, present on the website, the Customer uses its own credit card, or other card issued as replacement of the same, and charges on its current account in favor of Size Fishing the total amount highlighted as the cost of the purchase made "on-line". The whole procedure is made by means of a secure connection directly connected to the banker and/or operator of the payment service online Paypal, to which Size Fishing cannot access, Size Fishing will not be aware of the data relating to the credit card
• 9.2 If the consumer avails himself of the right of withdrawal, as set out in point 8 of these general conditions, the amount to be refunded will be credited to the same credit card.

Art. 10: CONTRACT RESOLUTION AND EXPRESSED RESOLUTION

• 10.1 Size Fishing has the right to terminate the contract stipulated by giving it simple communication to the customer indicating the motivation; in this case, the customer shall be entitled exclusively to return the sum already paid.
• 10.2 The obligations assumed by the customer referred to in Article 7 (Obligations of the buyer), as well as the guarantee of the good end of the payment that the customer carries out with the means referred to in Article 2, shall have an essential character, so that by express agreement, the failure, by the Customer, of only one of those obligations will determine the resolution of the right of the contract pursuant to Article 1456 c.
• 10.3 Size Fishing has full respect for your privacy. The data, which you transmit, will be processed by electronic means and will be used by Fishing Size only to allow us to manage orders and shipments. In accordance with Legislative Decree 196/03 Personal Data Protection Code, all information relating to personal data, orders and payments made are strictly reserved. We assure you that in no case and for no reason we will disclose your personal data to third parties outside of Fishing Size. Art. 11 Right to direct the European Dispute Resolution Organization:

• 12.1 Any dispute relating to the application, execution, interpretation and violation of purchase contracts concluded online through the website https://www.dimensionepesca.com/en/ is subject to italian jurisdiction; these general conditions are, however not expressly provided for therein, to the combined provisions of Legislative Decree no. no 50 of 15.1.1992 and Legislative Decree 206/05.
• 12.2 For any dispute between the parties concerning this contract, the Consumer Domicile Forum shall be responsible.
